Dr. Kathy Kellermann, M.A., M.S., Ph.D.
Dr. Kathy Kellermann, founder and President of ComCon, is an expert in communication and persuasive strategies with a rare combination of storytelling insight and quantitative expertise. For over 17 years, Dr. Kellermann has consulted on cases throughout the country and in the Southern California area where she resides. Dr. Kellermann works on all types of cases, particularly relishing cases involving complex scientific testimony. Dr. Kellermann is an expert in toxic torts (especially asbestos, mold, silica, and benzene), construction defects, environmental cases, civil rights, criminal defense (especially death penalty, insanity, violent offenses, sexual assaults, and white collar crimes), insurance (especially coverage and bad faith), employment (especially discrimination and wrongful termination), personal injury (especially wrongful death and product liability), contracts, and shareholder disputes. Dr. Kellermann is familiar with and knows how to adapt case arguments to the most difficult venues in the country. Recently, Dr. Kellermann helped defendants win critical “bet-the-company” cases in California and Texas, and a federal civil rights plaintiff win the single largest award ever against the Los Angeles County Sheriff’s Department. Dr. Kellermann has special expertise in mock trials, focus groups, case analysis, trial strategy, jury selection, witness preparation, attitude surveys and developing persuasive strategies and trial themes for openings, closings and witness examinations. Judicial observation is a service Dr. Kellermann uniquely offers trial teams.
As a nationally recognized authority on persuasion and communication, Dr. Kellermann is also an industry leading expert in research methods in designing, managing and conducting investigations; in analyzing, understanding and interpreting results; and in explaining, reporting and relaying findings. Dr. Kellermann has authored over 35 publications, including articles on witness preparation, hung juries, numerical displays, jury composition and compliance gaining strategies which are available in the [Articles Kollectionn] and [Persuasion Kollectionn]. Dr. Kellermann has given many presentations on jurors’ attitudes, and frequently teaches workshops on persuasive advocacy and storytelling techniques to litigators (see [Slide Shows] ). Dr. Kellermann regularly serves as a media commentator on trials and jury issues for TV, radio and newspapers. Among other topics, Dr. Kellermann has been sought for comment on gag orders, the State of California’s revised jury instructions, and the high profile criminal cases of O.J. Simpson, Scott Peterson, Michael Jackson, Phil Spector and Robert Blake (see [Media] ).For a number of years, Dr. Kellermann co-hosted a popular legal radio show, Santa Barbara Law, with public interest attorney Kirk Ah-Tye and past California State Bar President (and now Judge) Jim Herman.
Dr. Kellermann obtained a Ph.D. in Communication and an M.S. in Probability & Statistics from Northwestern University in Illinois, an M.A. in Communication from Wake Forest University in North Carolina, and a B.S. in Communication, Political Science and Psychology from Concordia College in Minnesota. Before turning her focus to litigation consulting, Dr. Kellermann was an award-winning professor and a communication consultant for local and national organizations. Dr. Kellermann has served on the Board of Directors of the International Communication Association and National Communication Association, and is a member of the American Society of Trial Consultants. Dr. Robert M. (Bob) McCann, M.A., Ph.D.
Dr. Robert McCann is a Senior Consultant with ComCon. Over the past twenty-plus years, Dr. McCann has cultivated and practiced his expertise in focus groups, public speaking, small group communication, marketing and research.
As a skilled communication consultant, Dr. McCann is especially gifted in focus group research and presentation assistance. Dr. McCann moderates focus group sessions that are appealing and comfortable for the participants, yet are also highly relevant and meaningful for his clients. Dr. McCann has worked with numerous participant groups, including doctors, non-native English speakers, university students, bankers, business executives, attorneys, older individuals, disadvantaged citizens and professionals from a wide variety of fields. Dr. McCann is an expert in working with participants and on cases involving the elderly and persons from other cultures.
Dr. McCann has experience with many industries - international banking, entertainment, consumer goods, pharmaceuticals, education and international trade - which gives him a unique and broad skill set that the litigation and focus group fields demand. As a recognized authority on communication, persuasion and marketing, Dr. McCann currently sits as Visiting Associate Professor of Human Resources and Organizational Behavior at the Anderson School of Management at the University of California, Los Angeles after serving as Associate Professor of Clinical Management Communication at the Marshall School of Business of the University of Southern California. Previously, Dr. McCann was also the Senior Johnnie Walker Brand Ambassador for the Asia region and served as the relationship marketing (mentor) manager for the Johnnie Walker brand in Thailand. In this capacity, Dr. McCann conducted nearly 2,000 promotional and media events, making him Johnnie Walker's busiest brand ambassador in the world.
In addition to his work in the spirits industry, Dr. McCann has a background in international banking and trade finance, where he held management positions in Karachi, London, and Los Angeles. During his nearly two decades in Thailand, Dr. McCann served as a communications consultant to many of Thailand's leading companies, including the Bank of Ayudhya, UOB, Nestle, Siam Commercial Bank, Thai Airways International, Worachak, and PTT.Dr. McCann is fluent in Thai, and has appeared in several television shows and TV commercials in Thailand.
Dr. McCann has written two books, published over thirty refereed journal articles, conference papers and book chapters, and has received several top paper and empirical research awards. Dr. McCann's recent work focuses on ageist language in the workplace, research that is used in age discrimination lawsuits. Dr. McCann serves as a frequent consultant to the media in the area of workplace ageism and age diversified workplaces, most recently appearing on National Public Radio, US News and World Report, Chicago Tribune, New York Times, GQ, Esquire, The Atlanta Journal Constitution, Capital Times, and International Herald Tribune among others (see news coverage of Dr. McCann's [Ageist Language Research] ). Dr. McCann has served as a professor at prestigious institutions in both the United States and Thailand, traveled to over 50 countries around the world, and lived in Spain, Pakistan, England and Thailand. Dr. McCann holds a Ph.D. in Communication from the University of California at Santa Barbara, an M.A. from the University of California at Los Angeles, and a B.A. from Emory University in Atlanta, Georgia.
